The National Environmental Management Authority (NEMA) has raised alarm over the illegal re-emergence of plastic bags in Kenya.
In a public notice issued on 8th September 2025, the authority warned that offenders will face tough legal action. The notice stated that anyone found manufacturing, importing, selling, or using plastic bags without a licence risks a fine of between KSh2 million and KSh4 million, imprisonment for one to four years, or both.
To operate legally, dealers in plastic packaging materials must obtain authorization from NEMA. Additionally, all approved products must clearly display the names and contact details of both the manufacturer and user. Licensing details are available on the agency’s website: www.nema.go.ke.
Kenya has been at the forefront of the global fight against plastic pollution. On 28th February 2017, the government announced a historic ban on the use, manufacture, and importation of plastic bags used in commercial and domestic packaging. This landmark decision placed Kenya among world leaders in environmental protection.
The commitment was reinforced on 4th November 2024, when the Cabinet Secretary for Environment gazetted the Environmental Management and Co-ordination (Management and Control of Plastic Packaging Materials) Regulations, 2024. These rules provide a clear framework for managing plastic packaging, promoting accountability, and encouraging sustainable alternatives.
NEMA reiterated that it remains committed to safeguarding the environment but stressed that success depends on public cooperation. The authority urged Kenyans to report illegal plastic trade and adopt eco-friendly packaging options to protect the country’s ecosystems and public health.
